Acceptance of terms

By accessing or using Merriments ("the Platform"), operated at merriments.in, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Platform.

Service description

Merriments is a browser-based party games platform that enables hosts to run interactive, real-time multiplayer games for live events. All services are delivered digitally — no physical goods are involved.

Account registration & eligibility

You may use the free features of Merriments without creating an account. To purchase a Pro plan or access premium features, you must create an account using a valid email address. You must be at least 18 years of age, or have parental/guardian consent, to make a purchase.

Payments & pricing

All prices are listed in Indian Rupees (INR). Payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway. We do not store your payment card details, UPI IDs, or banking credentials on our servers. By making a purchase, you agree to Razorpay's terms of service.

  • Pro Event Pass — a one-time payment that grants access to all games and premium features. The pass is valid for 24 hours from the time you create your first game room after purchase.

User responsibilities & prohibited uses

You agree to use Merriments only for lawful purposes. Without limiting the foregoing, you must not:

  • Use the Platform to conduct, facilitate, or promote any form of gambling, betting, wagering, or real-money gaming of any kind.
  • Collect entry fees, deposits, or stakes from participants in connection with any game hosted on the Platform, with the intent to distribute winnings or prizes funded by those contributions.
  • Offer, promise, or distribute cash, cryptocurrency, gift cards, or any monetary equivalent as prizes to participants through or in connection with the Platform.
  • Use the Platform to distribute harmful, offensive, defamatory, obscene, or illegal content.
  • Harass, threaten, or harm other users or participants.
  • Attempt to gain unauthorised access to the Platform, its infrastructure, or other users' data.
  • Use the Platform to conduct activities that violate the Promotion and Regulation of Online Gaming Act, 2025, the Information Technology Act, 2000, the Prevention of Money Laundering Act, 2002, or any other applicable Indian or international law.
  • Provide false information, impersonate another person, or misrepresent your identity or affiliation.

We reserve the right to suspend or terminate accounts that violate these terms, without notice and without refund, at our sole discretion.

Indemnification

You agree to indemnify, defend, and hold harmless Merriments, its operators, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including but not limited to PROGA 2025; (d) any content you create, host, or share through the Platform; or (e) any harm caused to participants at events you host using the Platform. This indemnification obligation survives termination of your account or these Terms.

Intellectual property

All content, branding, designs, and code on Merriments are owned by us and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without prior written permission.

Limitation of liability

Merriments is provided "as is" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

Termination

We may suspend or terminate your access to the Platform at any time for violation of these terms. You may delete your account at any time by contacting us through our support page.

Gaming compliance & legal classification (PROGA 2025)

Merriments operates as an Online Social Game as defined under the Promotion and Regulation of Online Gaming Act, 2025 ("PROGA") and the Promotion and Regulation of Online Gaming Rules, 2026, which came into force on 1 May 2026. Specifically:

  • The Platform does not involve staking, wagering, or betting of money by participants.
  • Participants do not deposit money with any expectation of monetary return or winnings.
  • Any fees paid to Merriments (subscription or Event Pass) are access fees for the Platform, not stakes or wagers in any game.
  • Merriments does not operate a prize pool, does not collect money from participants to distribute as prizes, and does not issue any monetary or equivalent rewards to players.
  • All games on the Platform — including quizzes, prediction challenges, pictionary, and spin the wheel — are offered solely for entertainment, recreation, and engagement at live events.

Prohibited host conduct. Hosts using the Platform agree that they will not:

  • Collect entry fees or deposits from participants through or in connection with the Platform for the purpose of creating a prize pool or distributing winnings.
  • Use the Platform to facilitate any form of real-money gaming, gambling, betting, or wagering, whether skill-based or chance-based.
  • Represent to participants that use of the Platform carries any expectation of monetary gain.
  • Offer cash, gift cards, cryptocurrency, or any monetary equivalent as prizes funded by participant contributions collected through the Platform.

Hosts who independently choose to offer non-monetary prizes or goodwill gifts at their own events do so entirely outside the scope of the Platform and at their own legal responsibility. Merriments bears no liability for any host-organised prize arrangements conducted independently of the Platform.

We reserve the right to suspend or terminate access for any host found to be using the Platform in a manner inconsistent with PROGA 2025 or any applicable Indian law. This section will be updated as the regulatory framework evolves.

Governing law

These terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Promotion and Regulation of Online Gaming Act, 2025. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated via the Platform. Continued use of Merriments after changes constitutes acceptance of the updated terms.
